This website, www.poptastica.com (the “Website”), is operated by Poptastica Limited (“Poptastica”, “we”, “us”, “our”).

By accessing the Website or placing an order, you agree to be bound by these Terms and Conditions, together with our Privacy Policy and Returns Policy.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to sell our products and services to you.

We reserve the right to amend these Terms at any time. Any changes will take effect immediately upon publication.

 


 

2. Eligibility

By placing an order, you confirm that:

  • You are at least 18 years of age;

  • You are legally capable of entering into binding contracts; and

  • The information you provide is accurate and complete.

 


 

3. Orders and Contract Formation

We reserve the right to refuse or cancel any order where:

  • Payment is not authorised

  • Products are unavailable

  • There is a pricing or description errorAll orders are subject to acceptance and availability.

After placing an order, you will receive an acknowledgement email confirming receipt. This does not constitute acceptance.

A legally binding contract is formed only when:

  • Payment has been authorised; and

  • We confirm acceptance of your order.

  • Fraudulent activity is suspected

If an order is cancelled after payment, you will receive a full refund.

 


 

4. Pricing and Payment

All prices are shown in GBP (£) unless otherwise stated and include VAT where applicable.

We reserve the right to:

  • Amend prices at any time

  • Correct pricing errors

  • Withdraw promotions

Payment must be made in full at checkout.

All card payments are subject to authorisation checks by the card issuer.

 


 

5. Consumer Rights (UK Customers)

Under the Consumer Rights Act 2015, goods must be:

  • Fit for purpose

If goods are faulty, damaged, or not as described, you are entitled to a repair, replacement, or refund in accordance with your statutory rights.

6. Right to Cancel (Distance Selling Regulations)

Under the Consumer Contracts Regulations 2013, you have the right to cancel most online orders within 14 days of receiving goods.

To exercise your right to cancel, you must notify us in writing within the cancellation period.

You then have 14 days to return the goods.

Refunds will be issued within 14 days of receiving the returned goods (or proof of return).

Exceptions – Customised & Personalised Goods

The right to cancel does not apply to:

  • Personalised products

  • Custom-branded merchandise

  • Goods made to your specification

Unless faulty, customised items are non-refundable.

 


 

7. Custom Artwork & Approval

Where you supply artwork or request branded products:

  • You confirm you own or have permission to use all intellectual property rights in submitted materials.

  • You are responsible for approving proofs before production.

  • We are not liable for errors once artwork has been approved.

If adjustments are required to make artwork suitable for print or embroidery, we will notify you of any additional costs before proceeding.

 


 

8. Delivery

Delivery times are estimates and not guaranteed.

We are not liable for delays caused by:

  • Courier services

  • Customs clearance

  • Supply chain disruption

  • Events beyond our reasonable control

Risk in goods passes to you upon delivery. Ownership transfers once full payment has been received.

 


 

9. Returns and Refunds

Where goods are not customised:

  • Items must be returned unused and in original condition.

  • Returns must be initiated within 30 days (unless faulty).

Refunds will be processed to the original payment method.

Customised products are non-returnable unless faulty or misdescribed.

 


 

10. Promotional Codes

Promotional codes:

  • Must be used within stated validity dates

  • Cannot be combined unless specified

  • May exclude certain products

  • May be withdrawn at any time

 


 

11. Website Use

You must not:

  • Use the Website unlawfully

  • Infringe intellectual property rights

  • Transmit malware

  • Interfere with Website security

  • Engage in fraudulent activity

We reserve the right to suspend or terminate access for misuse.

  • Fraud or fraudulent misrepresentation

Subject to the above, we shall not be liable for:

  • Loss of profits, business, or data

Our total liability shall not exceed the purchase price paid for the relevant goods.

 


 

14. Force Majeure

We are not liable for delay or failure to perform obligations where such delay results from events beyond our reasonable control, including natural disasters, industrial action, pandemics, or governmental restrictions.

16. Governing Law

These Terms are governed by the laws of England and Wales.
